Terms & Conditions
Any and all bookings with Table Mountain Tours (TMT) are subject to the following terms and conditions:
1.1 Conditions of the natural environment are naturally subject to changes, as is availability of services or suppliers and entrance into national parks, wine estates, restaurants, etc.
1.2 The information provided on this website (tablemountaintours.com) is therefore provided without any warranty or guarantee.
2.1 We DO NOT take bookings for less than the cost for two persons. Any booking confirmed for ONE person, will incur the minimum cost for TWO persons; unless confirmed in writing as a condition of your booking.
2.2 Where a booking is confirmed for ONE person and the additional fee waived, a surcharge of 50% will be applied.
2.3 Unless explicitly booked as a "PRIVATE TOUR" all TMT tours are non-exclusive bookings to join a group.
2.4 All bookings must be made and confirmed — at least 12 hours — in advance of the date and time of the tour.
2.5 Fees are not negotiable unless you have booked directly with us and NOT through an agent, hotel, concierge or travel desk.
2.6 Where you have booked directly with us, discounts can be negotiated ONLY for groups of FIVE or more.
3.1 Bookings made more than 2 days (48hrs) in advance, MUST be secured with a (min.) 50% non-refundable deposit; the balance being due within 48 hours of the date/time of the tour.
3.2 Where a booking is made less than 2 days in advance, payment must be made in full, 12 hours before the date and starting time of your tour.
3.3 TMT is not obliged to accept any conditions of your payment provider. Payments are ONLY accepted free of any surcharge or fees and subject to being received and confirmed BEFORE the date and starting time of your tour.
3.4 Where a payment provider imposes any terms or conditions on payment, TMT reserves the right to reject such terms or conditions; in which case the payment remains immediately due and owing.
3.5 Bookings are deemed 'paid' and therefore 'confirmed', upon notification to TMT that payment has been accepted and cleared into TMT bank account.
4.1 While we (obviously) won't want to cancel any tour, tours are subject to weather, entrance into parks, availability of services, third-party suppliers and other events beyond our control (see 6.10); and thus TMT reserves the right to alter, curtail or cancel any tour, before or after it has commenced, without notice.
4.2 In the event that your tour is cancelled by ourselves, you will receive a refund of all fees paid for services not delivered, less any non-recoverable costs already incurred or committed to third parties on your behalf, within 72hrs after the date/time of the tour. Where no such costs have been incurred, the refund will be FULL.
4.3 You may cancel your booking, UP TO 48 hours from the date and time of your booking, subject to forfeiture of your deposit (50% of the value of your booking), but without incurring any additional fees.
4.4 Cancellations within 48hrs of the date and time of your booking, will incur a 75% cancellation fee.
In other words — you forfeit your deposit and we forfeit the balance owing.
4.5 Where a 75% deposit has NOT been received for a booking cancelled within 48hrs of the date/time of your tour, the deposit remains due and owing.
4.6 You will also have the option of rescheduling your tour for an alternative date — subject to availability; in which case your deposit will be held in lieu of that alternative booking.
4.7 Such deposits will be held up to a maximum of 30 days, during which time you must redeem your deposit by alternative booking.
We are not liable for bad weather … and neither are you.
4.8 We do NOT cancel tours due to bad weather, UNLESS the bad weather makes the tour manifestly dangerous. In such event, where you have paid in full, you will receive a 50% refund.
4.9 Failure to arrive at the designated meeting point within 15 minutes of the pre-arranged start time of your tour is regarded as a ‘no show’, subject to forfeiture of all fees paid.
5.1 The duration of any adventure activity depends on your capacity (fitness) to walk/hike/scramble/climb/abseil, hence the duration of an activity stated is an average, based on our experience.
5.2 Your participation in any adventure (hiking, scrambling, abseiling, caving) activity is subject to your level of fitness and capacity to complete the activity, which you are requested to confirm in advance on a scale of “1” to “10”.
5.3 Your participation in any adventure activity is also subject to your capacity to tolerate moderate exposure to heights (where applicable); which you are also requested to confirm in advance on a scale of “1” to “10”.
5.4 Participants must be comfortable with direct (immediate) exposure to heights of 25m (twenty-five metres), without any panic (‘flight or fight’) response.
5.5 You acknowledge that by booking with TMT, you are responsible for communicating the capacity, rated on a scale of “1” to “10” (as specified in 5.2 and 5.3 above) to perform the adventure activity, for each member of your group.
5.6 You acknowledge that failure to communicate your capacity will be deemed confirmation that all persons for whom the booking is confirmed, are presumed to have the capacity to perform the adventure activity.
5.7 You thus warrant that by booking with TMT, each member of your group is capable of performing and completing the adventure activity.
5.8 TMT accepts no liability resulting from your failure to perform the activity.
All persons utilise TMT services, equipment and amenities at their own risk.
6.1 Acknowledgment of Risk: By submitting a booking with TMT you acknowledge that guided tours and activities, including hiking, scrambling, abseiling, caving, scenic drives and transfers, are inherently dangerous activities; and that you are aware of the associated risks, including but not limited to: falls, rockfall, equipment failure, unpredictable weather, difficult terrain, road and vehicle accidents, illness, wild animals, and/or remote locations where medical assistance may not be available.
6.2 Voluntary Participation: You acknowledge your participation is voluntary and at your own risk.
6.3 Health and Competency: You warrant that you are physically fit and have no medical conditions that would prevent your safe participation; and agree to comply with all instructions given by the guide/leader and to use the appropriate safety gear at all times.
6.4 Emergency Medical Treatment: In the event of injury, you authorise the guide/leader to seek medical assistance and/or evacuation on your behalf.
6.5 Indemnity and Waiver: To the fullest extent permitted by law, you warrant that TMT, its directors, employees and agents shall not be liable for any consequences of any injury, damage to or loss of property from any cause howsoever sustained by any person utilising TMT services.
You hereby release and hold harmless TMT, its guides and members and any fellow participants, from any and all liability, claims, or causes of action for any loss, damage, personal injury, or death that may occur during or as a result of this activity, whether such loss, injury or damage is caused by negligence.
6.6 Where you are booking for a group, you hereby warrant that you have communicated to and accept these Terms & Conditions on behalf of every member of your group, for whom you have booked.
6.7 Medical Disclosure: You must disclose, before the tour, any medical condition, injury, disability, pregnancy, allergy or medication that may affect your safety or that of others. TMT may decline or end your participation if, in the guide's opinion, it is unsafe; and in which event, no refund is payable.
6.8 Instructions of the Guide: The guide may, at their sole discretion, change, shorten or abandon any route or activity, or remove any person from a tour, where they consider it necessary for safety. Participants may not take part while under the influence of alcohol or drugs. No refund is payable where this results from a participant's conduct, fitness or failure to follow instructions.
6.9 Third-Party Suppliers: TMT tours depend on third-party suppliers, including vehicle-hire, accommodation, parks and reserves, ferries, airlines and activity operators. To the extent TMT arranges their services, it does so as intermediary, and TMT is not liable for any act, omission, failure, cancellation or unavailability of a third-party supplier, including where a supplier is unable or unwilling to provide a replacement. Third-party services are subject to the supplier's own terms and conditions.
6.10 Events Beyond Our Control: TMT may alter, postpone, curtail, suspend or cancel any tour, before or after it has commenced, due to any event beyond its reasonable control, including: severe weather, floods, fire, road closures, accidents, strikes, civil unrest, power or fuel disruptions, government restrictions, closure of parks or attractions, illness or injury of the guide where no replacement is available, and breakdown, damage, loss or unavailability of any vehicle. In such event, TMT is not liable for any loss, damage, cost or expense, whether direct, indirect or consequential, including flights, accommodation, onward travel, lost income or disappointment; and its liability is limited to the refund provided in 4.2.
6.11 Insurance and Costs: TMT does not provide insurance. You are strongly advised to hold travel, medical and emergency-evacuation insurance, including cancellation and curtailment cover, and to avoid booking non-refundable flights or onward travel that depends on a tour proceeding as planned. Any additional costs arising from a change, delay or cancellation, and all costs of medical treatment, evacuation or rescue, are for your own account.
6.12 Minors, Limits and Governing Law: Persons under 18 years may participate only if accompanied by a parent or legal guardian, who accepts these Terms & Conditions on their behalf. Nothing in these Terms & Conditions excludes liability for gross negligence or intentional misconduct, or any liability that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or any other applicable law. If any part of this Section is found to be unenforceable, the remainder continues to apply. These Terms & Conditions are governed by the laws of the Republic of South Africa, and the courts of the Western Cape have jurisdiction.
7.1 All tours are led by a fully-qualified, registered and experienced guide, who is able to provide professional advice on routes, duration, distance, technical difficulty, attire, equipment, historic attractions and landmarks.
7.2 Transfers from and back to your place of accommodation are NOT included; unless confirmed in writing as a condition of your booking.
7.3 Transfers that are included, will incur an additional fee, confirmed in writing as a condition of your booking; and are limited to the area from and including Mowbray, Observatory, Salt River, Woodstock, City Bowl, Waterfront, Sea Point, Camps Bay.
7.4 Adventure activities do NOT include refreshments.
7.5 “Peninsula Tour” and “Winelands Tour” include light refreshments, typically drinks (soft drink or fruit juice) and snacks (crisps or biltong and energy bar or fruit).
7.6 Lunch is NOT included with any of our tours and is at your own expense.
7.7 Entry fees to any destination (Kirstenbosch, Boulders Beach, Cape Point or Silvermine Reserve), museums, wine-tasting fees, or fees for the Table Mountain Cableway, are NOT included and are at your own expense, unless explicitly stated in writing as a condition of your booking.
8.1 TMT retains all copyright on any and all images captured and/or recorded by our guides and/or agents during any guided activity; and any images you share with our guides or agents.
